PLEASE READ THE TERMS OF THE FOLLOWING STATEMENTS and ACKNOWLEDGEMENT of PAYMENT is deemed accepting to the terms below:-
The following constitutes the Photography/Videography Agreement (the “Agreement”) of Metta Memories (the “Videographer/Photographer”). Please read the Agreement in its entirety and contact the Videographer/Photographer if you have any questions or concerns about the Agreement. As used in the Agreement, all references to “you” or “your” or the “Client” refers to the payer of this Agreement. Payment of final deposit serve as your electronic acknowledgement and agreement reflecting your assent to the terms and conditions of the Agreement. You will be able to preview the Agreement prior to payment by revisiting the page, at which time you are encouraged to print a copy for your records. It is understood that Metta Memories is the exclusive Videographer/Photographer retained by the client to cover outlined event. Any conflicts with other video/photography coverage contracts and any notifications necessary to avoid such conflicts are the sole responsibility of the client.
Client assumes all responsibilities for obtaining any necessary permission, clearance permits, etc., which may be required for Metta Memories each event, public or private. Client assumes all responsibility for obtaining and retaining permission for access to any requested camera positions and is solely responsible for the quality of the final production resulting from the use of, or inability to use, such camera positions. The client warrants that he/she has the legal rights to anything Metta Memories will video record, including still photos, musical recordings, videotapes, or any other materials delivered to Metta Memories for inclusion in the client’s video and picture gallery.
Metta Memories will establish an arrival time for the wedding date with the client prior to that date and remain on duty for the number of hours included in the package. Coverage hours included in the package are for the wedding date only and must be consecutive. Additional cash payment to be provided upfront if client requires additional hour/s of coverage on the day.
Coverage of weddings and other events exceeding 4 hours, suitable seating and meals arrangement to be provided to our team members serving on the day, as will be discussed during the initial pre-wedding consultation and accordingly coordinated with the venue. Additionally, for shoots extending beyond 4 hours, we request a 45-minute break to ensure optimal performance and service for the client. Your understanding and cooperation are greatly appreciated.
Metta Memories is not responsible for poor audio if the groom/bride does not agree to wear a lapel microphone, dark or grainy video resulting from inadequate lighting or the refusal of the client/venue to allow camera-top lighting and Light stands at the ceremony, reception, or electrical or mechanical malfunctions on location that are beyond our control.
Metta Memories reserves the right to use videos and photos for display and or promotional purposes. All video masters, raw footage and photographs remain the exclusive property of Metta Memories.
Artistic Style. On its own behalf and on behalf of the subject: Client acknowledges that he/she is familiar with the Metta Memories portfolio and is requesting services with knowledge of the company’s style and that Meta Memories work is constantly evolving; that the Metta memories services are of a unique and artistic nature; that the video may be different from videos done by the company in the past; and that in creating the videos/edit photos we shall use our own creative artistic judgment to create videos consistent with our personal judgment and consistent with our vision of the event, which may be different from the clients and or the subject’s vision of the event. Accordingly, client acknowledges that the videos shall not be subject to rejection on the basis of taste or aesthetic criteria. Additional Editing requests may attract additional fees subject to hourly rates.
Metta Memories does not provide RAW images. RAW Video in documentary style edit can be purchased at an additional cost determined by Metta Memories. The final product comprises of photographs and Videos that are carefully picked and curated for editing process.
Music Overlays and their licencing is initiated by Metta Memories for video content creation and advertising purposes solely. Metta Memories is not liable if client shares content of Metta Memories utilising unlicensed Music or SFX for copyright infringements.
If Metta Memories fails to comply with the terms of this agreement due to any event or at beyond the control of Metta Memories, including but not limited to illness, accident, labour disputes, acts of God and other catastrophes, or uncontrollable and unforeseeable equipment failure, Metta Memories’ liability is limited only to a refund of all monies received from the client including progress payments.
Adverse Weather Conditions Clause: In the event of heavy rain or other adverse weather conditions that prevent Metta Memories from performing its photography/videography services as planned, the client agrees to provide an alternative indoor location for the scheduled session. Metta Memories will not be held liable for any delays, interruptions, or inability to perform its duties due to adverse weather conditions. It is the client's responsibility to ensure that an adequate indoor backup location is available and suitable for the planned photography. Should no indoor alternative be available, the session may be rescheduled to a mutually agreed-upon date and time. Any additional costs incurred due to rescheduling or venue changes are the responsibility of the client.
The client reserves the right to terminate the contract for any reason up to 5 days after the date of deposit payment (Deposit). If Client terminates the contract past the 5 days cooling off period, then Metta Memories will not be liable for any refunds including progress payments made or due.
Delivery of final product: Metta Memories share the final product digitally as standardised package. If additional delivery options are provided part of the package then is to be discussed and updated in the invoice/contract upon agreement.
Standardised Delivery timeline for our Photography and Videography package is 4 Weeks from the Wedding day however delays may occur and Metta Memory Client to be kept updated every week post due date till project is delivered.
The payment plan will be put forward in the quote and the invoices. The full payment needs to be made prior to the event date as per the payment plan option provided. Our services will not proceed if full payment if not received by Metta Memories via EFT/ Credit Card Payment/ Cash.
Metta Memories is committed to providing professional photography and videography services and expects all clients, guests, and vendors to treat our staff with respect and courtesy at all times. Any form of misbehaviour, including but not limited to verbal abuse, physical threats, or harassment, will not be tolerated. In the event that Metta Memories staff experience any such behaviour, services will be ceased immediately, and no further work, including the delivery of any edited footage or photographs, will be provided. In such scenarios, no refunds will be issued, and Metta Memories reserves the right to take legal action if necessary. By signing this contract, the client acknowledges and agrees to this policy.
